Classes
Shell’s teachings are suitable for all levels including beginners. Shell hosts regular weekly classes and is also available for private bookings including one-on-one sessions or office and group yoga party bookings, either in person or virtually.
Yoga Activity Participant Waiver, Release, & Indemnity Agreement
Yoga classes, including but not limited to gentle Yoga, Restorative Yoga, Yoga Nidra, Meditation, Breathing Practices (Pranayama), Relaxation Techniques, Movement Exercises, Workshops, Trainings, Retreats, Kirtan & Chanting, online classes, and related activities will be collectively referred to as "Yoga Activities" from herein.
In consideration of my participation in these Yoga Activities and the services of Shell Andréa Yoga + Kirtan, their agents, owners, officers, volunteers, participants, employees, sponsors, and all other persons or entities acting in any capacity on its behalf, as well as their successor and assigns (collectively referred to as “the Instructors”), I, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate (collectively referred to as “Participant”), hereby agree to release and discharge the Instructors as follows:
1. Acknowledgment of Risk.
I, the undersigned Participant, understand that participation in Yoga Activities involves inherent risks and requires physical movement and other potentially strenuous or unpredictable experiences, which may expose me to risks, including but not limited to:

Physical injury or aggravation of a pre-existing condition (e.g., muscle strain, sprain, or falls)

Emotional or mental stress

Illness or disease

Acts of nature or other unforeseen circumstances
I acknowledge that these risks are inherent and cannot be fully eliminated without compromising the essential purpose and character of Yoga Activities or altering their nature.
2. Voluntary Participation.
I certify that my participation in Yoga Activities is entirely voluntary. I confirm that I am in good physical and mental health, and that I have sought medical advice if necessary, regarding my ability to safely participate in these activities. I will inform Instructors of any injuries, medical conditions, physical limitations, pregnancy, recent surgeries, or other health concerns that may affect my participation. I understand that it is my responsibility to monitor my own physical and mental condition during class and to stop or modify any activity that causes pain, discomfort, dizziness, shortness of breath, or other concerning symptoms. I understand that Yoga instruction is not medical advice and is not intended to diagnose, treat, cure, or prevent any medical condition. I understand that I may modify or decline any activity at any time, and I agree to take full responsibility for my own health and safety.
3. Assumption of Risk.
I freely and fully assume full responsibility for any and all risks of injury, loss, damage, or expense that I may sustain as a result of participating in Yoga Activities, whether arising from negligence or otherwise. I understand that I am solely responsible for my own health, safety, and well-being during Yoga Activities.
4. Release of Liability.
To the fullest extent permitted by the laws of the Province of Manitoba and the laws of Canada applicable therein, I hereby release, waive, discharge, and hold harmless the Instructors from any and all claims, demands, actions, causes of action costs, or expenses whatsoever, whether in law or in equity, that I or my heirs, executors, or assigns may have or may hereafter accrue, arising out of any loss, injury, damage, illness, or death that may occur during or as a result of my participation in Yoga Activities, whether caused by negligence or otherwise.
5. Indemnification.
I agree to indemnify, defend, and hold harmless the Instructors from any and all liabilities, claims, demands, damages, costs, or expenses (including reasonable legal fees) arising out of or related to my participation in Yoga Activities.
6. Personal Property.
I understand that I am responsible for my own personal property and belongings and that the Instructors are not responsible for loss, theft, or damage to personal items.
7. Governing Law and Jurisdiction.
This Agreement shall be governed by and construed in accordance with the laws of the Province of Manitoba and the laws of Canada applicable therein.
I agree that any dispute arising out of or related to this Agreement shall be subject to the exclusive jurisdiction of the courts of Manitoba, and I consent to the venue and jurisdiction of such courts.
If any provision of this Agreement is found invalid, the remaining provisions shall continue in full force and effect.
8. Acknowledgment and Agreement.
By submitting my name and email information below, I am declaring I have carefully read and fully understand this Waiver, Release & Indemnity Agreement. I am aware that it is a legally binding document, and I agree to it voluntarily and of my own free will. I agree to be bound by its terms and conditions in full.
