International Retreat Waiver

Yoga Retreat Participant Waiver, Release, and Indemnity Agreement

Retreat Organizers: Shell Andréa Yoga + Kirtan  
(collectively referred to as “the Organizers”)

​

In consideration of my participation in this Yoga Retreat and associated events and Activities (collectively referred to as “Retreat”) and the services of Shell Andréa Yoga + Kirtan, their agents, owners, officers, volunteers, participants, employees, sponsors, and all other persons or entities acting in any capacity on its behalf, as well as their successor and assigns (collectively referred to as “the Organizers”), I, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate (collectively referred to as “Participant”), hereby agree to release and discharge The Organizers as follows:

1. Acknowledgment of Risk.

I, the undersigned Participant, understand that participation in a Yoga Retreat involves physical activity, travel, and other potentially strenuous or unpredictable experiences, which may expose me to inherent risks, including but not limited to: 

• Physical injury (e.g., muscle strain, sprain, or falls) 

• Emotional or mental stress 

• Illness or disease (including, but not limited to, foodborne or infectious illnesses) 

• Accidents during transportation, excursions, or recreational activities 

• Adverse weather or environmental conditions 

• Acts of nature or other unforeseen circumstances 

I acknowledge that these risks are inherent and cannot be fully eliminated without compromising the Retreat’s essential purpose and character or altering its nature.

2. Voluntary Participation.

I certify that my participation in the Retreat is entirely voluntary. I confirm that I am in good physical and mental health, and that I have sought medical advice if necessary, regarding my ability to safely participate in Yoga, meditation, Kirtan, travel, excursions, and related activities. I acknowledge that it is my responsibility to listen to my body and only participate in activities that I feel comfortable and physically capable of performing. I understand that I may modify or decline any activity at any time, and I agree to take full responsibility for my own health and safety during the Retreat.

3. Assumption of Risk.

I freely and fully assume full responsibility for any and all risks of injury, loss, damage, or expense that I may sustain as a result of participating in the Retreat, whether arising from negligence or otherwise, including but not limited to travel to and from the Retreat location and to and excursion or event while in transit. I understand that I am solely responsible for my own health, safety, and well-being during the Retreat.

4. Release of Liability.

To the fullest extent permitted by the laws of the Province of Manitoba and the laws of Canada applicable therein, I hereby release, waive, discharge, and hold harmless: The Organizers, their respective owners, directors, officers, employees, instructors, contractors, agents, affiliates, volunteers, and representatives from any and all claims, demands, actions, causes of action costs, or expenses whatsoever, whether in law or in equity, that I or my heirs, executors, or assigns may have or may hereafter accrue, arising out of any loss, injury, damage, illness, or death that may occur during or as a result of my participation in the Retreat, whether caused by negligence or otherwise. This release covers all Retreat-related activities, including but not limited to Yoga classes, meditation, Kirtan, excursions, travel and transportation, accommodations, and meals organized by or on behalf of the Organizers.

5. Indemnification.

I agree to indemnify, defend, and hold harmless the Organizers, along with their affiliates and representatives, from any and all liabilities, claims, demands, damages, costs, or expenses (including reasonable legal fees) arising out of or related to my participation in the Retreat or any of my actions or omissions during the Retreat.

6. Health, Medical, and Travel Insurance.

I acknowledge that the Organizers do not provide health, medical, or travel insurance for participants. I confirm that I have, or will obtain, comprehensive travel and medical insurance covering international travel, medical care, accidents, illness, and emergency evacuation.

7. Travel Documentation Responsibility 

Participants acknowledge and agree that they are solely responsible for obtaining, maintaining, and presenting all required and valid travel documentation necessary for participation in the Retreat. This includes, but is not limited to, passports, visas, vaccination or immunization records, and any other entry, exit, or health requirements mandated by the destination country or any transit jurisdictions. Participants further acknowledge that such requirements may change at any time and it is their responsibility to remain informed and compliant. Organizers shall not be held liable for any consequences arising from a Participant’s failure to secure or maintain proper documentation, including but not limited to denied boarding, refusal of entry, delays, additional expenses, or inability to attend the Retreat. No refunds, credits, or compensation will be provided in such circumstances.

8. Health, Hygiene, and Conduct.

I agree to act responsibly and respectfully throughout the Retreat, honoring local customs and laws and maintaining good personal hygiene to protect the health of the group. If I exhibit any symptoms of illness (including but not limited to coughing, fever, sore throat, congestion, or fatigue), I agree to: 

• Notify a retreat leader immediately, and 

• Wear a mask while in tight quarters with the group and traveling with the group in a shared vehicle (e.g., car, bus, van, or shuttle) to minimize the risk of infecting others. 

I understand that the Organizers reserve the right to restrict participation in group activities if they determine that doing so is necessary to protect the health and safety of other participants. I also understand that any participant whose behavior is unsafe, disruptive, or inappropriate may be asked to leave the Retreat with no refund or compensation provided.

9. Photo and Media Release.

I grant permission to the Organizers to use photographs, videos, recordings, or other digital media of me taken during the Retreat in any and all of its marketing, including web-based publications, without payment, compensation or other consideration.

10. Satsang & Lecture Recordings.

While participating in any Satsangs (group discussions), lectures, or other teachings, I agree that I will not record these teachings in any way including, but not limited to, audio and video recording.

11. Cancellation Policy.

I acknowledge and agree to the Cancellation Policy set forth on the Event Page of the website, which includes that deposits are non-refundable and that any and all refunds are not guaranteed and are at the sole discretion of the Organizers.

12. Governing Law and Jurisdiction.

This Agreement shall be governed by and construed in accordance with the laws of the Province of Manitoba and the laws of Canada applicable therein.

I agree that any dispute arising out of or related to this Agreement shall be subject to the exclusive jurisdiction of the courts of Manitoba, and I consent to the venue and jurisdiction of such courts. 

If any provision of this Agreement is found invalid, the remaining provisions shall continue in full force and effect.

 

13. Acknowledgment and Signature.

I have carefully read and fully understand this Liability Waiver and Release. I am aware that it is a legally binding document, and I agree to it voluntarily and of my own free will. By submitting my Application Form online, I agree to be bound by its terms and conditions in full.
